1. ACCEPTANCE OF TERMS

These Terms of Service (“Terms”) constitute a legally binding agreement between the User (“You”, “Your”) and Bani Global Industries LLP (“Company”, “We”, “Us”, “Our”) governing the use of the LexiTrip platform, including all travel services offered.

By accessing, browsing, or using LexiTrip, You acknowledge that You have read, understood, and agreed to be bound by these Terms and our Privacy Policy, Refund Policy, and all other applicable policies.

If You do not agree, You must discontinue using the platform immediately.

2. SCOPE OF PLATFORM

LexiTrip operates as an online travel marketplace facilitating bookings for:

  • Flights (Domestic & International)
  • Hotels & Homestays
  • Bus & Cab Services
  • Train Tickets (via IRCTC Authorised Partners)
  • Visa Assistance
  • Tourism Packages
  • Travel Insurance
  • Ancillary Services (Meals, seats, baggage, upgrades)

LexiTrip is an intermediary as defined under the Information Technology Act, 2000. LexiTrip does not own, control, operate, or manage airlines, hotels, buses, taxis, railways, embassies, or travel service providers.

3. USER ELIGIBILITY

To use LexiTrip, You must:

  1. Be at least 18 years old
  2. Have the legal capacity to enter binding contracts
  3. Use valid credentials & payment instruments
  4. Not be suspended or removed by LexiTrip
  5. Not engage in fraudulent or prohibited activities

Minors may use the platform only under parental/guardian supervision.

4. USER ACCOUNT & RESPONSIBILITIES

A. Account Creation

You must provide accurate details including name, phone, email, and travel documents.

B. User Obligations

You agree to:

  • Maintain account confidentiality
  • Use genuine identification documents
  • Ensure passport/visa validity
  • Verify booking details before confirming
  • Not misuse the platform, APIs, or supplier systems
  • Update personal information as required

C. Account Termination

LexiTrip may suspend or terminate accounts for:

  • Fraud
  • Chargeback abuse
  • Booking misuse
  • Breach of Terms
  • Violation of supplier rules
  • Security threats

5. ROLE OF LEXITRIP AS AN INTERMEDIARY

LexiTrip acts purely as a digital intermediary. We facilitate bookings and transmit data to suppliers (airlines, hotels, bus operators, IRCTC partners, embassies, visa centers, insurance companies, etc.).

The final responsibility for delivery of travel services lies with the respective supplier.

LexiTrip is not responsible for:

  • Flight cancellations/delays
  • Airline or hotel overbooking
  • Visa rejection
  • Operational issues by transport operators
  • Immigration decisions
  • Schedule/route changes
  • Loss of luggage
  • Quality of accommodation or transport

6. BOOKING, PRICING & PAYMENT TERMS

A. Pricing

Prices displayed are dynamic and may change at any time due to real-time supplier pricing. LexiTrip does not guarantee price stability.

B. Booking Confirmation

A booking is confirmed only after:

  1. Successful payment
  2. Supplier (airline/hotel/operator) confirmation
  3. PNR/voucher/booking ID issuance

C. Payment

Payments must be made through approved payment gateways. LexiTrip does not store card information (tokenized via PCI-DSS compliance).

D. Service Fees

LexiTrip may charge service, convenience, or platform fees. These are non-refundable.

E. Chargebacks

False chargebacks are treated as fraud and may result in:

  • Account suspension
  • Legal action
  • Blacklisting across API networks

7. CANCELLATIONS, CHANGES & REFUNDS

All cancellations, refunds, modifications, and no-show rules are strictly governed by airline, hotel, operator, embassy, and supplier policies.

LexiTrip refunds only after supplier approval.

Detailed rules are specified in the LexiTrip Refund & Cancellation Policy, which is part of these Terms.

8. TRAVEL DOCUMENTS & USER COMPLIANCE

You are solely responsible for ensuring:

  • Valid passport
  • Visa & immigration documents
  • Correct spelling of names
  • Correct date of birth
  • Vaccination or medical requirements
  • Compliance with airline, hotel, embassy, and country rules

LexiTrip does not verify or edit travel documents.

Visa rejection, denied boarding, or immigration refusal does not entitle You to a refund beyond supplier rules.

9. IRCTC & RAILWAY COMPLIANCE

Train bookings made through LexiTrip are subject to:

  • IRCTC Rules
  • Railway Act
  • Tatkal rules
  • Chart preparation rules
  • ID verification norms

LexiTrip is not responsible for PNR confirmation, RAC/WL movements, no-show penalties, or schedule changes.

10. AIRLINE COMPLIANCE & AVIATION RULES

Air travel is governed by:

  • DGCA regulations
  • Individual airline terms
  • Global aviation protocols
  • Airport & security laws

Airlines may change schedules, deny boarding, alter baggage rules, etc. These decisions are outside LexiTrip’s control.

11. HOTEL & PROPERTY COMPLIANCE

Hotels reserve the right to deny check-in for reasons including:

  • Invalid ID
  • Local ID restrictions
  • Unmarried couple policies
  • Safety concerns
  • Overbooking

Refunds in such cases depend solely on hotel/vendor policy.

12. VISA ASSISTANCE SERVICES

LexiTrip provides document assistance only. The final decision lies with the Embassy/Consulate/VFS/BLS.

LexiTrip is not responsible for:

  • Visa rejection
  • Additional document requests
  • Processing delays
  • Interview outcomes

All visa fees are non-refundable.

13. PROHIBITED ACTIVITIES

You agree not to:

  • Create fake bookings
  • Use fraudulent payment methods
  • Manipulate prices
  • Interfere with APIs
  • Use bots or scraping tools
  • Conduct chargeback fraud
  • Use multiple fake accounts
  • Disrupt platform security
  • Resell LexiTrip services unauthorized

Violation may lead to account suspension and legal action.

14. INTELLECTUAL PROPERTY

All content, branding, UI/UX components, logos, trademarks, texts, graphics, and code on LexiTrip are owned by Bani Global Industries LLP.

Unauthorized use, reproduction, or distribution is strictly prohibited.

15. DISCLAIMERS

LexiTrip provides services on an “as is” and “as available” basis. We do not guarantee:

  • Accuracy of supplier data
  • Real-time availability
  • Uninterrupted access
  • Error-free systems
  • Supplier performance

LexiTrip shall not be liable for indirect, incidental, consequential, or punitive damages arising out of travel services.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by law, LexiTrip’s liability is limited to:

  • The amount paid by the User for the specific booking
  • No liability shall exist for circumstances outside LexiTrip’s direct control
  • No liability for supplier acts, omissions, negligence, or service deficiencies

17. INDEMNIFICATION

You agree to indemnify and hold harmless Bani Global Industries LLP, employees, directors, partners, and affiliates from any claims arising from:

  • Breach of these Terms
  • Misuse of the platform
  • Fraudulent transactions
  • Violation of supplier rules
  • Wrongful chargebacks
  • Third-party claims related to your booking

18. PRIVACY & DATA PROCESSING

Use of the platform is governed by the LexiTrip Privacy Policy, which explains:

  • What data we collect
  • Why we collect it
  • How we process and share it
  • How long we store it
  • Data protection measures

By using LexiTrip, You consent to data processing practices described therein.

19. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India. All disputes shall fall under the exclusive jurisdiction of the Courts at Delhi, India.

20. CHANGES TO TERMS

LexiTrip reserves the right to modify, update, or revise these Terms at any time. Continued use of the platform after updates constitutes acceptance.
